Why the certificate of occupancy conditions everything
Without a certificate of occupancy (cédula de habitabilidad), water and electricity supplies cannot be registered in the new owner's name, the property cannot be rented out, and many banks will not grant a mortgage. In an old masía, obtaining it depends on the building being properly registered and meeting minimum requirements for surface area, ventilation, and habitability.
Existing building vs. extension
On non-developable land, the key is to distinguish between:
- Renovating what already exists: usually viable if the built volume is recognised in the Cadastre and municipal planning.
- Extending volume: much more restricted. It typically requires a project submitted for assessment by the territorial urban planning commission.
- Change of use (for example, from agricultural to residential or rural tourism): depends on the municipality's catalogue of masías.
The catalogue of masías
Many Catalan municipalities have a catalogue of masías and rural houses. If the property is listed, there is a clear framework for renovating it and even using it for rural tourism. If it is not, the process is slower and not always viable. Checking this before signing a deposit agreement (arras) avoids the most costly mistake in this market.
Non-conforming volumes and unpermitted building work
It is common to find sheds, porches, or extensions built without a licence. Depending on the elapsed time and municipal regulations, they may be time-barred (statute of limitations), consolidated, or subject to a demolition order. Every volume must be reviewed individually, cadastral record in hand.

Before formalising a deposit agreement, we request an urban planning certificate, review the municipal catalogue, and cross-reference the Cadastre with the Land Registry.
